The work examines, with contributions from authoritative scholars in the field, the regulations contained in Legislative Decree 231 of 2001, thoroughly accounting for both substantive and procedural law aspects. The structure of the offense, organizational models, supervisory body, corporate groups, sanctions, crimes from which the entity’s liability stems, various phases of criminal proceedings, and precautionary measures are, along with other topics, the subject of a documented and comprehensive reflection. The analysis is conducted with regard to the most recent legislative interventions (most recently Law No. 116 of August 3, 2009), which have further expanded the original scope of the discipline. In reconstructing the institutions, particular attention has been paid to jurisprudential interventions, given that the subject has assumed significant and growing judicial importance. From this perspective, more space than in other works on the same subject has been given to procedural aspects, in order to enhance its usability not only for those working on the prevention side but also for those called to apply the subject in courtrooms.
